Karlsruhe Affirms Real-Estate Tax

Too bad  Karlsruhe did not rule real-estate tax as unconstitutional. Wink


Two proprietors complained to the Federal Constitutional Court in Karlsruhe that they were allegedly infringed in their constitutional right of property – Art. 14 GG. They argued that their own home does not generate any turnover as rented houses do. Taxation is based on the ability to pay principle. It was, therefore, illegal to levy a tax on self-used house-owners not renting. The Federal Constitutional Court rejected such application. This decision came without explanation.
