I.) Standard Terms and Conditions for the Use of the Portal
§1 Application
(1) These standard terms and conditions will be applicable to the relationship between the reader and LG2G and also for contractual or tortous claims of other persons arising from the reader / editor relationship insofar as nothing else has been agreed upon in text or is legally compulsory. Alexander von Engelhardt is the contractual partner of the reader and will be reffered to as the "publishing editor" or "LG2G". "LG2G" applies to other editors, which are not the contractual partner of the reader, in relation to their published contents. This is especially true when it comes to questions of liability of the published contents.
(2) It is planned to enter this business into a corporation in the near future. As soon as this corporation has been established and this business transferred to this corporation, all rights and obligations of Alexander von Engelhardt will be transferred to this corporation.
§2 Right and Rules of Membership
(1) Generally, every application of readership is intended to be granted. LG2G however reserves the right to refuse to accept any person as a reader. LG2G reserves the right to delete accounts created by readers who appropriate the name, likeness, eMail address, or other personally identifiable information of another individual.
(2) By agreeing to these terms, the reader affirms that they will not use this portal to harass or abuse other members. Individuals who have demonstrably harassed other individuals via comments to articles, or using other means may be removed from LG2G. The Reader is fully responsible for any content he or she posts on the LG2G, including, but not limited to, photos, personal profile(s), testimonials, – and the consequences of any such content. The Reader understands and agrees that LG2G may review from time to time and delete any content that violates this agreement or which might be offensive, illegal, or harm the safety of or violate the rights of other readers and editors. Content that is illegal or prohibited, includes, but is not limited to, material, text, graphics, video or audio that:
- is unlawful, harassing, libelous, abusive, threatening, harmful, bigoted, racially offensive, obscene or otherwise objectionable,
- is intended or designed to disrupt an ongoing conversation via flaming (a message in which the writer publicly attacks another participant in overly harsh, or personal terms) or trolling (deliberately posting derogatory or inflammatory comments in order to bait other readers into responding),
- encourages conduct that could constitute a criminal offense, gives rise to civil liability or otherwise violate any applicable local, state, national or international law or regulation,
- transmits or posts any unsolicited or unauthorized advertising, "spam," junk mail, "chain letters," "pyramid schemes," etc.,
- transmits or posts any content that infringes upon patents, trademarks, trade secrets, copyrights or other proprietary rights,
- transmits or tries to transmit any viruses or material designed to disrupt, limit or destroy any functionality of any computer software or hardware of readers, members or the LG2G,
- collects, stores or solicits information about other readers or members for commercial or unlawful purposes or engage in commercial activity such as contests, sweepstakes, etc. without LG2G prior consent,
- contains personally identifiable information about another member that is published without their express consent,
- contains material originally posted by another member that is reposted without permission or attribution,
- advertises any illegal services or the sale of any items prohibited or restricted by German law,
- has misleading eMail addresses or other manipulated identifiers to disguise its origin.
(3) Hate speech is not acceptable and will not be tolerated on LG2G. As defined by LG2G, hate speech may consist of symbols or images, as well as text. LG2G defines sexually oriented content as any material that depicts, in actual or simulated form, or explicitly describes, in a predominantly sexual context, human genitalia, any act of sexual intercourse, any act of sadism or masochism, or any other eroticsubject directly related to the foregoing. LG2G may terminate the your reader's membership and delete any and all information or postings, at any time, without notice, for conduct that violates this agreement.
§3 Scope of Reading
(1) The scope of the accessable information of the portal depends on the scope booked. Generally, there are two scopes: "private" and "business" readership.
(2) Private readership grants access to menu "Private Legalities", its submenues, non-business articles in the archives, and other basic information for everyday private interest. This other basic information is determined by the LG2G. Private Readership aims to inform on topics not of professional, commerial, or business nature.
(3) Business Readership grants access next to the scope of "Private Readership" also to the menu "Business Legalities", its submenus, and "Business Articles" in the newsletters archives and other business topics of everyday business concern. "Business Readership" aims at informing on topics of the investor's, professional's needs to start, take over, and run a business in Germany.
§4 Membership Prices
(1) Membership will be granted upon application and after filling out the registration form on the website. Private memership is intended for the period of a year and will automatically renew itself for another year if not terminated latest one month prior to expiration. Business Membership is for the period of a half year and will automatically renew itself for another half year if not terminated latest one month prior to expiration. The period of membership starts after the month the publishing editor receives payment. Access to portal shall be made possible latest within one working day after receipt of payment.by the publishing editor.
(3) Private membership costs € 120 for one year. Business membership costs €60 for one half year. Prices are subject to change upon notice of the publishing editor and become valid upon renewal of the contract.
(4) Trial membership will be granted for the applied scope of readership. Trial membership starts on the day LG2G receives payment and will end in 14 days. If reader does not send termination of readership latest one day prior to expiration, the trial readership will become binding pursuant to above paragraphs in this section. If payments are made to another account than mentioned in the invoice, LG2G may understand this a non-refundable donation. Payment will be returned cost-free only after receiving funds to LG2G's fiduciary account and returning funds to a bank account in Germany. LG2G will follow other payment instructions, when the reader comes up for the transferal costs.
§5 Copyright Protection
The law on intellectual property is also applicable to the portal. The accessable information is only allowed to be used for private needs. Any other use for publication is without prior consent of the editor(s) is strictly forbidden and is subject to international penal prosecution. Please contact the editor if the Reader or somebody else wishes to use anything for their publication.
§6 Miscellaneous
(1) German law will exclusively rule this contract and its interpretation. The place of fulfillment and/or jurisdiction for any dispute arising out of this contract is at the Editor’s office.
(2) No standard terms and conditions, printed or otherwise published, which conflict with the provisions of these terms, will be binding for the publishing editor.
(3) LG2G will not be held liable for any loss or damage for non-compliance. In addition, the Reader understands and agrees that the content of all readers, including his or her content, will be collected, aggregated and anonymously integrated into the LG2G system. The Reader understands, and agrees that, unless expressly stated, LG2G in no way controls, verifies, or endorses any of the information contained on or in the LG2G portal, including links, events, messages, message boards and members published classifieds.
II.) Disclaimer, Indmenity of Warranties
(1) The Reader expressly agrees that use of the portal and/or any graphics or other content he or she downloads from the LG2G site is at his or her sole risk and that he or she will be solely responsible for any damage to their computer system or loss of data that results from the download of files, and/or any other content. The files and/or any other content the Reader downloads from the LG2G portal are provided on an "as is" basis. LG2G expressly disclaims all warranties of any kind, whether express, implied, statutory or otherwise, including, but not limited to the implied warranties of merchantability, fitness for a particular purpose and non-infringement. Neither LG2G will make any warranty that the files and/or other content the Reader download from the LG2G portal will meet his or her requirements, be timely, secure, or error free; nor does LG2G make any warranty as to the results that may be obtained from the use of the portal or as to the accuracy or reliability of any information obtained through the portal. This disclaimer is true and valid as long as LG2G does not act gross negligently or purposely.
(2) The Reader hereby agrees, at his or her expense, to indemnify, defend and hold LG2G harmless from and against any loss, cost, damages, liability, and/or expense arising out of or relating to
- third party claims, actions or allegations of infringement based on information, data or content the Reader submitted in connection with the service,
- any fraud or manipulation, or other breach of this agreement, by you, or
- third party claims, actions or allegations brought against LG2G arising out of your use of the service.
(3) This agreement constitutes the complete and exclusive understanding and agreement of the parties relating to the subject matter hereof and supersedes all prior understandings, proposals, agreements, negotiations, and discussions between the parties, whether written or oral. You understand and agree that you are solely responsible for reviewing the terms of this agreement from time to time. Any continued use of the service by you after such amended terms have been posted or information regarding such amendment has been sent to you, shall be deemed your consent and agreement to such amended terms.

On some LG2G webpages, you can order products or services, register yourself. IV.) Terms of Purchase for Buying eLiterature
§1 Closing of Contract
(1) Your order is only an offer to LG2G to enter into a contract, when not paying on the spot. A binding contract will then only come into existence upon full payment of purchased item(s) and by forwarding of the purchased item(s) to you. Receiving an eMail from LG2G or any payment service provider confirming your order is not the acceptance of your order but only the confirmation that LG2G or the payment service provider has technically received your order as is detailed in the eMail. Contractual partner is LG2G, Alexander Baron von Engelhardt.
(2) LG2G is not selling products to minors. All products are to be purchased by adults.
§2 Revocation
(1) You generally have the right to revoke your order in text form (e.g. eMail) or written form (e.g. letter, fax) without any reason within two weeks after submitting it. To keep this deadline, it suffices to timely forward your revocation. This means that the order will only be processed after two weeks – after the period of revocation has elapsed. (2) You also have the possibility to waive this right if you wish to immediately to purchase the articles.
§3 Delivery
(1) Unless not otherwise specified, the articles will be sent from LG2G’s address to the customer’s address as supplied by the customer after full payment has been received. Any period or date of delivery is without binding unless expressly stated as assured.
(2) For the case LG2G cannot deliver the ordered articles without own fault, LG2G will immediately inform the customer and will be entitled to cancel the contract. Customer’s statutory rights remain reserved.
§4 Maturity, Payment, Default
(1) The customer can pay per financial service providers like Paypal, MoneyBookers or spot payment methods like Mobilpay or Phone Payment. Bank checks will not be accepted.
(2) If the customer comes into default, LG2G may separately invoice EUR 20 for each reminder and charge 15% default interest. If a customer shows that LG2G could have only demanded less interest or damages, then lower damages be applicable.
§5 Setting off Counterclaims
The purchaser has only then the right to set off any counterclaims if they have been unappeasably acknowledged in court or are uncontested by LG2G and only if they arise from the same contractual relationship.
§6 Reservation of Property
Delivered goods remain in full property of LG2G until full payment has been established.
§7 Liability for Defects
(1) In case a product is defect; the statutory rules will be applicable. The assignment of these claims is debarred.
(2) Since the products sold on this portal have legal contents, may it be emphasized that these products are not legal consultation but only unbinding and impersonal information on the law. The given information may only be used at own risk. LG2G will not be held liable for the correctness, relevance to the current situation of the sold contents. LG2G will not be held liable for damages outside of the sold object. There will especially be no liability for lost profit or other monetary damages. In as much as the contractual liability is barred insofar will the personal liability for any employees, agents of any legal kind of LG2G be barred.
(3) The limitation of liability in subsection 2 is not true for liability based on intention or gross negligence or if a person is injured. This limitation is also not valid if it statutory rights are being claimed.
(4) In as far as LG2G does not meet a relevant contractual duty, the liability will be limited to damages typically occurred.
(5) For the case of a defect that the customer demands subsequent fulfillment, the customer must first return the defect products to LG2G at LG2G’s costs.
§8 Applicable Law
German law will exclusively rule the construction and application of the contract.
